1. Data Origin

We process personal data we have obtained from you or gained about you in the course of the application procedure. Additionally, we process personal data – to the extent we need them for making a decision on the establishment of the employment relationship – we gather in a legal way from publicly accessible sources (such as the Internet).

3. Purpose and Legal Basis of the Data Processing

We process the personal data you have provided with an application exclusively for the purpose of applicant selection and in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act of Germany:

3.1 To Perform a Contract (Art. 6 (1) (b) GDPR in Conjunction with Art. 88 GDPR, Section 26 Paragraph 1 Sentence 1 of the Federal Data Protection Act).
We process your personal data for the purpose of deciding on the establishment of an employment relationship.

3.2 On the Basis of the Consent You Have Given (Art. 6 (1) (a) GDPR in Conjunction with Art. 88 GDPR, Section 26 of the Federal Data Protection Act)
If you have given us consent to process personal data for certain purposes (e.g. storage in our applicant pool), this processing is lawful on the basis of the consent you have given. You can revoke your consent anytime. To exercise this right, a short message to the contact details stated above is sufficient. The withdrawal of consent is effective for the future and does not have any impact on the lawfulness of the data processing that was performed before the consent was revoked.

4. Recipient of Your Personal Data

We only transfer your personal data to third parties if this is permitted by law or if you have given prior consent. Within DENIC, access to your data is granted to those units that require it in order to fulfil our pre-contractual and legal obligations (e.g. possible superiors, Human Resources, works council, representation of the severely disabled). If necessary, data may also be transferred to DENIC Services GmbH & Co. KG. Your data may further be made available to external service providers, such as service providers that we commission within the framework of order processing relationships.

5. Retention of Your Personal Data

If your application leads to an employment relationship with DENIC, your personal data will be transferred to your personnel file. If your application is not accepted, your data will be deleted by us six months after the non-acceptance. If the data processing is performed on the basis of your consent, the personal data will be deleted as soon as you revoke your consent for the future.

6. Your Rights

To exercise your rights of access, rectification, erasure, restriction of processing, data portability and your right to object in accordance with Article 15 to Article 21 GDPR, a short message to the contact details stated above is sufficient. If, in exceptional cases, we process your personal data on the basis of your consent, you have the right to withdraw your consent for processing your data in the future anytime (Article 7 (3) GDPR). To exercise this right, a short message to the contact details stated above is sufficient. Pursuant to Article 77 GDPR, you also have the right to complain to a data protection supervisory authority if you believe that we are not processing your personal data in a lawful way. 7. No Automated Decision-Making

We do not apply any automated decision-making pursuant to Article 22 GDPR to implement an employment relationship.
